Terms of Service

Please read these Terms of Service (“Terms”) carefully before downloading, installing, accessing, or using the Parfumier mobile application (the “App”) or accessing https://parfumier.app (the “Site”).

Parfumier is owned, published, and operated by Cece Studios (“Cece Studios”, “we”, “us”, or “our”), a digital product studio registered in England and Wales. By downloading, opening, or continuing to use Parfumier, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the App.

You affirm that you are at least 13 years of age (or 16 years of age in the UK and European Economic Area). If you are between 13 and the legal age of majority in your jurisdiction, you may only use Parfumier under the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

Parfumier is an iOS-first, offline-first digital fragrance sanctuary designed to digitize your perfume collection into a visual display shelf, log your daily Scent of the Day (“SOTD”), calculate Cost-Per-Wear metrics, analyze your Scent DNA accord profiles, provide weather-matched scent suggestions, and generate high-resolution shareable trays.

Subject to your compliance with these Terms, Cece Studios grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable limited license to install and run the Parfumier application on Apple-branded mobile devices that you own or control, solely for personal, non-commercial purposes, in accordance with the Apple App Store Usage Rules set forth in the Apple Media Services Terms and Conditions.

This license does not convey any ownership interest in the software. All rights not expressly granted to you are reserved by Cece Studios.

Cece Studios Intellectual Property: All software code, graphical assets, icons, user interface designs, custom bottle vector silhouettes, soundscapes, editorial typography systems (“Obsidian & Champagne”), database compilations, and mathematical algorithms (including Scent DNA accord weights, Cost-Per-Wear formulas, and weather-fit heuristics) are the exclusive intellectual property of Cece Studios.

User-Generated Content: You retain complete ownership of any personal notes, star ratings, custom photographs, or custom note pyramids you create. By uploading or creating content within the App, you grant Cece Studios a non-exclusive license solely to process and display that content locally on your device and inside user-requested export files.

All financial transactions, payments, and billing for Parfumier are processed exclusively by Apple Inc. via the iOS App Store.

You agree to use Parfumier solely for lawful purposes. You shall not, directly or indirectly:

• Decompile, reverse engineer, disassemble, or attempt to extract the source code or cryptographic keys of the App.
• Bypass, alter, or circumvent any subscription paywalls, security gates, or feature locks.
• Scrape, crawl, or harvest our curated fragrance catalog, accord classifications, or API endpoints.
• Abuse the AI Vision Shelf Scanner by uploading malicious software, unlawful images, non-fragrance media, obscene material, or attempting denial-of-service exploits against our proxy infrastructure.
• Impersonate Cece Studios, our developers, or any third-party fragrance brand.

Automated Vision Processing: The Vision Shelf & Screenshot Import feature uses artificial intelligence (Google Gemini Flash-Lite) to extract text and recognize flacon silhouettes. While engineered for high fidelity, AI extraction is provided “AS IS”. Optical accuracy is inherently subject to image resolution, bottle angle, lighting conditions, and typography variations. You acknowledge that AI output may occasionally produce inaccurate matches and that you are responsible for reviewing and confirming matched items before committing them to your shelf.

Subjective Olfactory Information: Fragrance accord pyramids (top, heart, and base notes), longevity ratings, sillage scores, and weather-fit recommendations provided in Parfumier are mathematical models and curated opinions provided solely for personal organization and enjoyment. Fragrance perception and actual longevity on skin vary substantially based on individual skin pH, ambient temperature, humidity, and manufacturing batch variations.

Please read this section carefully as it limits Cece Studios’ legal warranties.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE APPLICATION, THE WEBSITE, AND ALL CONTENT AND SERVICES ACCESSED THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

CECE STUDIOS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL OPERATE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR SECURITY VULNERABILITIES, OR THAT LOCAL STORAGE OR ICLOUD SYNCS WILL BE IMMUNE FROM TECHNICAL FAILURE. YOU ASSUME FULL RESPONSIBILITY FOR MAINTAINING REGULAR EXPORTS OF YOUR DATA USING THE BUILT-IN EXPORT UTILITIES.

Important limitations under English Law:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CECE STUDIOS, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE PARFUMIER.

IN NO EVENT SHALL CECE STUDIOS’ TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF:

• THE TOTAL AMOUNT PAID BY YOU TO CECE STUDIOS FOR PARFUMIER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
• TWENTY-FIVE POUNDS STERLING (£25.00 GBP).

Statutory Carve-Out: Nothing in these Terms shall limit or exclude Cece Studios’ liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be lawfully excluded under the laws of England and Wales.

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

You and Cece Studios irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the App.

Consumer note: If you are an individual consumer resident in another jurisdiction (such as Scotland, Northern Ireland, or an EU Member State), you may benefit from mandatory provisions of the consumer protection laws of your country of residence that cannot be derogated from by agreement.
